Welcome to Birch Space. These Terms of Service govern your use of our HR management platform. By using our services, you agree to these terms.

1. Acceptance of Terms

By accessing or using Birch Space, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Description of Service

Birch Space provides HR management software including employee management, time tracking, leave management, document storage, and related features. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring the accuracy of information you provide
  • Complying with all applicable laws and regulations

4. Data Ownership

You retain ownership of all data you upload to Birch Space. We do not claim any ownership rights to your data. You grant us a limited license to use your data solely to provide the services you request.

5. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Upload malicious code or attempt to breach security
  • Interfere with other users' access to the service
  • Resell or redistribute the service without authorization
  • Use the service in violation of anyone's privacy rights

6. Payment Terms

During the beta period, the service is provided free of charge. When we transition to paid plans:

  • Fees will be charged according to the pricing displayed
  • Payments are due monthly unless otherwise agreed
  • You will receive notice of any pricing changes
  • Refunds are handled on a case-by-case basis

7. Limitation of Liability

To the maximum extent permitted by law, Birch Space shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

8. Indemnification

You agree to indemnify and hold harmless Birch Space and its affiliates from any claims arising from your use of the service or violation of these terms.

9. Termination

Either party may terminate the agreement at any time. Upon termination, you may export your data within 30 days. After that period, we may delete your data according to our retention policies.

10. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes. Continued use of the service after changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
